Welcome to the YANGO DELI platform (the "Platform") owned and managed by the company Yango Deli Israel Ltd., whose registered address is: 40 Hamsgar St., Tel Aviv, Tel: 077-2200809, Fax: 03-7618008 (the "Company" and /or "Yango").

On this page, you will find detailed terms of use for the platform users. Please, check for updates from time to time, and read the terms of use carefully as the changes may be made that will come into force in accordance with the terms provided below.

The application may only be used on devices with IOS or Android operating systems.

These Terms of Use are written in masculine gender for the convenience of use only and are equally applicable to both genders. Where the contents of the platform and/or these Terms of Use contain wording in singular, they equally apply to both singular and plural, as applicable.

If you have any questions or problem, please, contact our customer support via e-mail support.deli@yango.com or use the customer support chat on the platform (“customer support”). The support service is available during our business hours for any question and/or request and/or problem.

Our customer support is intended for providing you with any help you may need in solving issues and problems associated with the use of the platform and the queries associated with orders thereon.

By using the service, the user gives their consent to the Terms of Use. The mere performance of any action in the application or on the platform means your consent with the Terms of Use, and that you shall abide by these terms.

The company may make amendments to the Terms of Use at its sole discretion. Amendments to the Terms of Use shall enter into force once they are published on the platform, in accordance with the law, with no preliminary notification being necessary. Please, note that material amendments to the Terms of Use will be accompanied by preliminary notification on the main page of the platform. Your continued use of the platform and the services provided thereon after the amendments to the Terms of Use have taken effect will mean your consent with and acceptance of such new Terms of Use.

Amendments to the Terms of Use shall take legal effect once they are published on the platform, so you should check for updates of the Terms of Use and the Privacy Policy from time to time.

If you disagree with the Terms of Use of the platform, whether in full or in part, please, do not use the platform and the services provided thereon.

If you are younger than 18, please, carefully read our Terms of Use together with your parent or other custodian. If you and/or your parents disagree with the Terms of Use, whether in full or in part, you are not allowed to use the platform for any purpose at all.

Platform Use & General Instructions

1.The YANGO DELI platform consists of digital platforms, applications and/or websites of the company and its affiliates, whereon the YANGO DELI service is available for use. The platform offers diverse sales of food, household goods, pharmaceutical drugs, etc. available on the platform (the "Services"). Nothing in the description of products offered on the platform could be seen as a recommendation or opinion for the acquisition of certain goods.

2.Anyone making any action on the platform, inter alia, anyone making a purchase (the "User"), declares, while making any action on the platform, to have read these terms of use and agreed with their provisions, and that the purchasing performance on the platform will be in line with the conditions set out in these terms of use; moreover, the user or anyone acting on their behalf will have no claims towards Yandex or anyone acting on their behalf, or towards any of their executives, employees, or affiliates, except for claims associated with the express obligations of Yango in accordance with these terms of use.

3.Yango may, at any time and at its own discretion, revise, delete and/or add services, content, or information to be displayed on the platform, and/or decide at its own discretion with respect to their arrangement, layout, and any other issues howsoever related to the services, including their scope and availability, with no preliminary separate notification being required.

4.The services and/or some of them are "location-based services" using positioning software (GPS) for the determination of your location. Please, note that some services may not be provided without the user's consent for the use of that software, therefore, the user grants their consent for Yango to use positioning software to send an order to the address specified by the user.

5.The use of the platform is intended exclusively for private and personal purposes, do not copy, use, or convey any content from the platform to others for copying or utilization for purposes other than for private and personal use. The sale of products and services on the platform is not intended for wholesale or reselling business (purchase of a certain amount of products on the platform to sell them to other customers).Yango is entitled to limit the amount of products that can be purchased according to commercial considerations as well as operational and supply limitations.

6.The user may use the platform and the services in accordance with the terms of use only. Do not use or allow others to use the platform and the services in violation of the terms of use.

7.Do not launch computer applications, software and/or other means for searching, copying, scanning, or retrieval of services, information or content from the platform. In accordance with these terms, do not create or use the above means for copying and creation of databases that would contain any content from the platform. Notwithstanding the generality of this provision, the prohibition to use information does not apply to the operation of common search engines that yield links directly to the site.

8.When registering and/or placing an order, the user should provide their personal data such as phone and/or e-mail address, as well as data on their location or place whereto the user wants to order delivery. Payment for the order will be made exclusively by a bank card. Yango may revise the platform policy and the provision of details, and define additional methods of identification for signing up to the platform.

9.Various product images presented on the platform are intended for the visual description of goods only, and in the case of discrepancy between the image, name, and labeling (the "Bar-code") of a product, the bar-code of that product shall prevail.

10.A service provided on the platform is only provided within the coverage areas defined by the platform, which may change from time to time at the discretion of Yandex without preliminary notice ("Coverage Area"). In order to find out whether a specific addressee is within the coverage area, you will need to fill in the delivery address, and the platform will determine whether or not the requested address is available for delivery.

11.As part of the defined Coverage Areas mentioned, there are the YANGO DELI branches- the layout of which can be seen on the platform. It will be clarified that each branch is an independent unit regarding the prices and sales promotions offered - the applicable prices can be seen within the platform for each branch. Also, ordering from a certain YANGO DELI branch is possible- to existing addresses within the distribution of its Coverage Area. Orders to the addresses according to the Coverage Area can be checked within the platform.

12.The price of goods and products will be according to the price lists displayed on the platform, determined according to the Coverage Area and the branches, which will be updated at Yango's own discretion and will be published on the platform.

13.The platform offers promotions as well as to execute purchase and sale transactions. Yango may offer promotions, benefits and discounts on the platform. Promotions are limited in time and/or quantity and in accordance with the stock readily available at each office of YANGO DELI. Yango may cease, replace, or change them at any time and without any additional or preliminary notice. The platform may offer certain promotions only to customers, who are signed up to its customer club program.

14.The company sends users marketing pushes (the "Pushes") to elevate user experience in the application according to the activity in the application as well as part of the activity updates and sales promotions. When using the application, you agree to receive Pushes from the company through the application as stated above. You can stop receiving the above-mentioned by closing this option through the device settings on Android or IO.

15.The platform offers a wide variety of goods, generally available in stock, and the company makes every effort to keep up with the available stock. Nevertheless, the company reserves the right to limit the delivery of products, and therefore, goods may appear whose delivery methodis limited to a certain type of delivery, or which are available for delivery within a certain time only, at the platform's discretion. These limitations will be displayed to the user within the platform. Furthermore, the platform company has the right to limit the number of goods (whether identical goods or products of the same type) that each customer can acquire from the multitude of goods within each order on the platform, as will be presented to the user before placing the order on the platform.

16.Yango reserves the right, at its own discretion, to restrict access of a user to the platform (or to certain functions of the platform, where technically possible) by using the user's account, or fully block the user's account, or exercise any other measures due to violations of these terms of use (including limitation or cancellation of orders that, in their features, are deemed to breach these terms of use), violations of provisions of law, impairments of rights and interests of third parties and/or Yango, considerations of public safety or in the case of certain legal obligations of Yango.

17.Unauthorized or offensive uses are prohibited: the user undertakes to use the platform and/or services provided thereon in good faith. The user shall not use the platform for stalking any other users and/or Yango. The user shall not inflict any harm to the reputation, property and other users and/or Yango.

18.Yango is authorized to suspend the provision of services on the platform from time to time for the purposes of maintenance, repair, updating, and improvement of the provision of all or some of the services, in which regard the user shall lay no claims and/or sues.

19.The Shipping fees charged at the platform for delivery may be at different rates between one order and another, depending on the Coverage Area and the user's shopping cart (herein: "Shipping fees"). The Shipping fee may change depending on the order’s delivery address, timing, and its distance from the branch. Options and/or Shipping fees will be displayed before placing the order on the platform, and those are the determining rates for the order to be placed by a user (the shipping fees determined as stated will also apply when adding products to an order, following what is detailed in section 3.4 below).

20.The company will have the right to deny delivery of orders to an address located outside of the coverage area when access to the area is restricted for the benefit of safety, for technical reasons, or because of special necessary actions for the delivery of the order to a certain region, or if the courier may be in danger, or for any other reason.

21.Yango may, at its discretion, revise and/or cease the functioning of the platform at any time, without the need to provide any warning and/or preliminary notice.

1.The Goods

1.1 The "Goods" are foods and other consumer goods that are being sold through the platform and the delivery of which has been ordered by a user when making an order on the platform, in accordance with the terms of use.

1.2 The goods will be showcased in lists displayed on the platform ("List of Goods") and in accordance with the location specified by the user.

1.3 Yango is entitled to replace any goods showcased in the list of goods on the platform, to change it in the list or delete from the said list at any time, whereas Yandex is not obliged to ensure the availability of the assortment of goods on the platform.

1.4 The method of showcasing the goods on the platform will be determined by the Yango at its discretion. It is expressly announced that the images of the goods showcased on the platform are intended for illustration only and do not impose any obligations whatsoever on Yango.

1.5 If during the handling of an order of the platform's user it is found that one or more goods are absent in stock, such goods will not be included into the final invoice, and their price will be deleted from the order list.

1.6 The purchase of tobacco products (cigarettes etc.) and alcoholic drinks is only allowed to users older than 18 years; upon delivery of such goods the user shall produce their identity document or driver's license and/or other documents confirming the user's age. Yango may deny delivery of the aforesaid goods to the user if doubts arise as to whether or not the user or recipient of the order is at least 18 years old. Do not sell any alcoholic drinks after 11:00 p.m. and before 6:00 a.m. By including tobacco products (cigarettes etc.) and alcoholic drinks into the order, the user confirms that he is over 18 years old.

1.7 Only a certain amount of any goods is allowed to be ordered by the user as part of the purchase. Adequacy of the quantity of goods will depend on the sole discretion of the platform.

2.The Prices

2.1. The prices of items shown on the platform are the prices as were last updated - before the date the user visited the platform at the time the user entered and confirmed the order, whichever is later (if the prices of the items in the cart change) (hereinafter: "Product prices"). Yango may update the Product prices on the platform from time to time, and display different Product prices in different branches according to the relevant service area, regardless of the user's order placement. Notwithstanding the above, the Product prices of the items included in the users order, displayed on the platform at the time his order is placed, will remain for 10 minutes from the time of placing the order (unless the platform has changed them at its discretion). There may be a difference between the prices shown on the platform and outside YANGO DELI and/or coded prices that appear on some of the products (hereinafter: the "Coded prices"). The determining price is the one that is on the platform, even if a different price appears on the products themselves.

2.2. Payment for weighted goods will depend on the actual weight of the products, it should be noted that there may be discrepancies between the weight requested by you and the final weight for reasons of service operation. For the avoidance of doubt, when placing an order for weighed products, the system will calculate the amount of your order according to the weight requested by you for that product plus 10% (based on the price per kilo as shown on the platform) and this for operational reasons. After that, the actual billing will be carried out according to the weighing of the products close to their delivery to the user. As part of this procedure, a frame will be seized on the means of payment through which the order is placed, in the amount of the estimated order value according to the weight of the product requested by you plus the 10%. If the weighing of the products is carried out at the time of delivery will be lower than the value of the order as calculated for payment, Yango will refund the user for the difference. If the user chooses other payment methods available on the platform (that are not credit cards) - the refund will be made to the user through a coupon for a future purchase at Yango Deli platform only, the validity of which is for two years.

2.3. The item prices are shown inclusive of the value added tax (VAT).

2.4. The user agrees and confirms that he should place an order with a total cost equal to or greater than the minimum order cost established on the platform to acquire goods and place an order. Yango may change the minimum order cost on the platform at any time by way of increasing and/or decreasing the same with no prior notice. The change may be attributed to, among other things, variation of the level of demand in a certain coverage area where the user is placing his order.

3.The purchase process on the platform

3.1. When individual items are added, a shopping cart is created for purchases that the user intends to make to acquire from the multiple goods displayed on the platform.

3.2. Completion of the purchase once the cart filling is finished will be done by clicking on the 'Pay' button or a similar button. After that, the user is required to enter the details and delivery data of the order, including the recipient's name, delivery address and contact information. Also, at this stage the user can change the payment method previously entered in the system.

3.3. At the end of the order placement process, you will be taken to a page confirming the creation of your order and its submission for further processing.

3.4. It is possible to add products after the order has been placed and paid for by the user (hereinafter: "adding products to the order"). To clarify, whenever a user chooses adding products to the order, the products will be priced according to the prices appearing on the platform as a new shopping cart, regardless of the order placed and paid for by the user. For example, if the platform offers a sale on the purchase of a cart of products (for example - a discounted price for the purchase of 4 items), it will not be possible to calculate the products added to the order after the first payment has been made to receive the discounted.

3.5. Acceptance of your order to acquire goods will constitute an offer on your behalf to acquire them, and acceptance of the offer will be affected by completing the order on the platform, subject to availability at the time of delivery and in accordance with the provisions of these rules.

4.Payments

4.1. Payments on the platform will be made by means of a credit card owned by the user or by other methods as available to you in the application. If the user intends to use another credit card, he will need to enter its details on the platform, and the new data so entered will be saved on the platform along with the previous data entered by the user. Yango uses external clearing services that are in line with PCI – a strict standard intended to ensure protection of credit card data and for billing the credit cards. Clearing companies are companies who keep the user credit card data and actually transact the payments.

4.2. The user will need to enter the credit card details in the platform interface as follows:

4.3. If the credit card details are correct, valid, and it is technically possible to use this card within the platform, the said credit card will become the user's linked card and can be used for making payments (the “linked card”). All the linked cards are displayed in the platform's interface. For the user's convenience, the interface will be displaying the last 4 digits of each linked card.

4.4. To confirm the details validity of the linked cards, an amount not exceeding 1 NIS will be debited from the user and, if the transaction is completed successfully, this amount will be returned to the user (the “collection and refund procedure”). Incapability to pay the aforesaid amount will mean that such a linked card cannot be added to pay for the order on the platform. Please note, when adding a payment method and linking another card in the platform interface, the collection and refund procedure will be carried out as detailed above.

5.Platform activity hours

5.1. Orders can be placed on the platform within its working hours, except for the cases when it is shut down for technical reasons and/or for any other reason. The dates and times of order delivery are regulated by the conditions described in detail in these terms of use. The platform displays the delivery dates available for delivery depending on the region where the order is placed and with regard to the coverage areas.

5.2. Placement, revision, or cancellation of an order by way of addressing the customer support via the chat on the platform are only possible within the working hours of the customer support. The working hours are updated from time to time at Yango’s discretion with no prior notice and are published on the platform.

5.3. The customer support's working hours are indicated on the platform.

5.4. The working time schedule of the platform and services are indicated on the platform.

5.5. For the avoidance of doubt, without prejudice to the terms of use, amendments/exceptions are possible in the delivery terms as well as in the customer support's working hours, whereas Yango shall bear no obligations in relation to such times or working hours.

6.Delivery

6.1. The delivery of goods acquired on the platform is only possible if the requested address is situated within the coverage area and if no technical or other obstacles exist that would hinder the delivery of such goods. It is hereby explained that the goods are available via the platform's delivery centres or any other place the company may select at its own discretion for the distribution of goods among the customers.

6.2. The goods included in an order will be delivered by the platform ("Delivery") subject to these terms of use in respect of the platform's rights not to deliver any goods from one of the branches working within the platform that will be selected by the platform or the user in accordance with his location or choice.

6.3. It is hereby explained that the delivery of goods for a placed order will depend on the performance of the transaction and on the arrival of payment from the credit company. The platform reserves the right to decline, at its own discretion, any payment that is unacceptable to it at a certain moment.

6.4. The goods will be delivered by the estimated time shown on the platform. However, the delivery time may change due to a variety of factors (weather, traffic jams, etc.) independent from each other and not attributable to the platform.

6.5. The platform will try to deliver all the goods on the order, but nor all goods will always be or may be available for delivery within the specified time limits. Consequently, the platform does not undertake to deliver all the goods in the order, regardless of whether or not information on their availability in stock is specified, and the user will not have any claims to the platform for non-delivery of any goods from the order. The platform will provide to the user only those goods that are readily available in stock at the branch that furnishes the order at the moment of preparation of its dispatch.

6.6. The platform will not charge the price for the goods within an order that will not be delivered in accordance with the provisions stated above.

6.7. In the event that the user did not request the delivery to be left outside the door, but the courier arrived at the delivery destination that the customer entered on the platform, and the user and/or anyone on their behalf did not open the destination door and/or did not answer a phone call from the courier and/or the company, the user agrees and confirms that the courier will leave the delivery outside the address entered by the customer on the platform - and the responsibility for the quality of the delivery and the included products will be solely the user's responsibility, and they will have no claims or demands against the company in this matter. The provisions of this section shall not apply to deliveries that include tobacco and alcohol products - for which leaving the delivery outside the door is not allowed at all, and in the event that the user is unavailable - the entire delivery will be returned to the branch from which it was sent, and the customer will be refunded for their order.

6.8. When filling in the necessary details, the customer may choose the requested type of delivery for his order at the requested address, as the application allows. In certain cases, the application will allow the user to choose delivery of the order by means of a robot that will execute the order ("Robot"), and this will depend on the availability of robots and correction of the order's data (ordered quantity, requested coverage area, time of the order). In the case of delivery of an order by the robot, please consider the following: The delivery time may be extended approximately to 30 to 40 minutes. The robot arrives at the entrance of, and does not enter the building, so, you have to meet it to pick up the order once you receive the message on the robot's arrival, which will be available to you via the platform. The robot will await you for 15 minutes, whereupon, if the order is not picked up, it will be returned to the office. In that case, the customer will have to pay an extra charge for the delivery, if such an order has been redelivered. Robots cannot be used for delivering alcoholic drinks and tobacco products (as the user's age needs to be verified).

6.9. In the case of delivery of an order by courier, if the user has confirmed that his order will be left at the door, the user does that fully at his own risk and will not lay any claims or demands to the platform, including, but not limited to, the events of theft of goods and/or requests of return of the same. The user will be charged the full amount of payment for the order as if it had been delivered to him. For the avoidance of doubt, it is not allowed to leave an order containing tobacco products and/or alcoholic drinks at the user's door, and the delivery of orders containing such goods will only be possible upon producing a document confirming that the order's recipient is at least 18 years old.

6.10. Subject to the provisions of the Consumer Protection Law, failure by the platform to meet the time of delivery will in no way relieve the user from his liability to pay for his order, and the payment paid by him for the order will not be returned. Without detracting from the foregoing, after the order has been delivered, Yango will send the user's account on the platform a tax invoice/receipt that will include a detail of the products ordered.

6.11. For the avoidance of doubt, records of the platform's data processing computer will be final and conclusive proof in respect of the operations and transactions performed via the platform, including the time of confirmation of an order by the platform user and the time of issue of an invoice by the platform.

7.Return of goods

7.1. The user should check the contents of the order upon receipt and reconcile them both with the order items and with the invoice that will be presented to him at the time of delivery of the order.

7.2. Should any discrepancy of the goods be found upon the aforesaid check, the user should notify the customer support hotline via the platform within 24 hours after the date of delivery of the order.

8.Cancellation/change of the order

8.1. The user may cancel an order or change it via the platform no later than the assembly of the goods begins at the providing office.

8.2. In the case of a change or update of the cart of goods by the user, the prices, promotions and bonuses in the order will be updated in accordance with the day of closure and dispatch of the updated order.

8.3. It is expressly stated hereby that the user's right to return goods and the user's right to cancel a purchase will be exercised exclusively in line with the provisions of the applicable law as well as with the provisions of the 1981 Consumer Protection Law, the provisions of the 1968 Trade Law, the provisions of the 2019 Payment Service Law, and the rules established in accordance with the said regulations and/or in accordance with the platform's policy, which can be amended from time to time. If an order is canceled (not due to a defect or discrepancy) after it is sent from Yango branches - the user will be charged a cancellation fee at the rate of 5% of the transaction price or NIS 100, whichever is lower.

8.4. Without detracting from the above, a user who has chosen to make the payment on the platform using other payment alternatives, as far as possible in the application, will be subject to the restrictions on the use of those payment methods, including restrictions regarding the cancellation of a transaction made through them. In these cases, no refund will be given for the other payment methods, but a credit coupon for a future purchase on the Yango Deli platform only, which will be limited to the period of use listed in the coupon, and subject to Yango Deli's cancellation policy.

8.5 Cancellation / Return of Electronic Products

8.5.1 If the user orders an electronic product that is in the designated category, and the product is broken externally, the user should contact the customer service center of the platform. The customer service center will initiate an internal inquiry process, and if the customer's inquiry is found to be justified, the product will be collected from the customer by a platform courier – in coordination with the user. Once the externally broken product arrives back at the branch, the user will be refunded according to the law.

8.5.2 If the customer ordered an electronic product that is not defective, the return of the product will be as detailed in the platform's cancellation policy, as mentioned above.

8.5.3 Anyway, technical and operational service for electronic products will be provided by the products’ provider only. The contact details of the provider will be mentioned in the product page in the Platform.

9.Comments about the goods

9.1. The data displayed on the goods are provided by the suppliers of those goods and are their responsibility.

9.2. The marking and description of goods may contain errors and/or inconsistencies.

9.3. Allergens / gluten — do not refer to the information stated in the ingredients of the product on the platform. Study the label of the goods before using them.

9.4. The images are intended for illustration only.

10.Warranty & Liability

10.1. Part of the information on the goods offered for sale on the platform comes from manufacturers and/or importers of the goods (hereinafter the "Manufacturers"); Yango posts it on the platform as provided. Yango does not verify whether such information is true, full, accurate or consistent with the real characteristics of the goods, and we rely on the results of checks by the manufacturers according to the law. Yango shall not be held responsible for any inconsistency, absence, deceit or error contained in the information or concerning its nature or inconsistency with your needs or its description. Yango shall not be held responsible for any information on products or their ingredients that is stated in recipes, videos, food or health advice.

10.2. Responsibility for the use of the platform is imposed solely on the user. The use of the platform and the content is provided to you free AS IS, and the user will have no claims or demands to Yango and/or anyone acting on its behalf concerning the specifics of use or service, its possibility or limitation, or its consistency with the user's needs.

10.3. Yango shall not be held responsible for any loss caused to the user directly or indirectly as a result of damage, breakage or defects of the provided goods, except for the cases where the defect has occurred through negligence from Yandex. In that case, the responsibility of Yango will be limited to the amount equivalent to the price of the order.

10.4. Yango neither guarantees nor undertakes to guarantee that the services on the platform will be provided smoothly or uninterruptedly, will be of high quality, will be provided safely and without errors and/or disruptions, and will also be secured from unauthorized access to its computers and/or software, including protection from damages, faults, malfunctions of hardware or software, lines of communication with Yango or with one of its suppliers or with you, and you will have no claims to Yango in this respect. It is not unlikely that a service may be unavailable in the future due to technical maintenance, updating, or for any other reason.

10.5. If the user has overpaid or underrated the cost while placing an order as a result of mischarging of the goods by Yango, the user will be credited the entire difference, and he will not have to pay the rest, and the deficient amount will not be charged from him. Due to late payment for an order, the payment will be transacted at a different time, and the User will not lay any claims and/or demands to Yango and/or anyone acting on its behalf, and/or any of its executives, and/or any of its employees, and/or any of its subsidiaries due to the delayed payment.

10.6. The placement of commercial information and/or advertising information on the platform is solely informative in nature and cannot be construed as an offer by Yango and/or anyone acting on its behalf to use and/or recommend, and/or encourage, and/or give one's consent to, and/or support, and/or issue an expert opinion on, and/or act as a sponsor of the platform in respect of any content and/or services offered on the platform. In its essence, the publication of products by YANGO DELI does not express any opinion of Yango and/or anyone of its representatives in respect of consistency of the products with the user's needs and/or the level and quality of the products and/or any information, advertisement, reference, services or products displayed on the platform. Neither the company nor its representatives shall be held responsible for the contents of any ads or commercial information published on the platform on behalf of third parties.

10.7. Yango may cease the provision of services on the platform and/or shut down the platform and change its structure, appearance, working hours and availability of services and products offered on it from time to time with no prior notice to the users. The use of the platform after any change thereof shall mean consent by the user with the platform's terms and conditions in its changed form.

10.8. Neither Yango nor anyone acting on its behalf are or will be held responsible before the user and/or any third party for any damages (including, but not limited to, damages arisen through the loss of a database, the loss of software, delivery, expenses for an alternative service or disruptions of service), whether direct or indirect, secondary, ancillary, accessory, arising as a result of the use of the platform or the impossibility of using it, acquisition of goods and services, performance of transactions, deliveries, or as a result of unauthorized use of the platform or as a result of a change in the information provided by you, including any damage inflicted as a result of a loss of profit, use or loss of information and other intangible assets, even if the platform has been notified about the likelihood of infliction of such damages.

10.9. The user shall be responsible for any direct or indirect outcome resulting from the use of the platform, and the user shall indemnify Yango and/or anyone acting on its behalf for any claims, losses, demands, forfeitures, payments, expenses or damages, including, among other things, compensation of expenditures for legal fees and legal costs (including those to third parties), resulting from the use of and/or impossibility to use the platform and/or violation of these terms of use. The use of the platform is regulated by the currently valid laws and rules applicable to the user, and he undertakes not to violate any laws and/or rules in connection with the use of the platform. Furthermore, the user will not test and/or will not try to test the system's sensitivity, nor will he try to hack the security or authentication system, will not interfere with the operation of the system and/or any networks connected to the platform, nor will he breach any laws, rules, policies, or processes of other systems and/or networks, he will neither gain nor try to gain unauthorized access to the platform, accounts of other users, computer systems and communication networks connected to the platform.

10.10. Yango cannot absolutely guarantee safety or integrity of information, nor does it guarantee that the platform or its use will be totally protected from unauthorized access to the information or contents stored on it. It is therefore expressly stated that Yango will not be held responsible in the case of intrusion or hacking and/or other damage inflicted in connection with the use of the platform in the contents provided on it and/or allied services by the user or anyone acting on his behalf.

11.Intellectual property

11.1. Intellectual property in general means copyrights and/or trademarks, and/or models, and/or patents and similar rights to the platform, including the platform's design, software, applications, graphic files, texts, images, technologies, processes, contents, icons, computer code, and all other materials included in the platform ("Platform Contents"), fully and solely owned by Yandex and/or legal entities related with it, and/or third parties from whom Yandex has obtained permission for the rightful use.

11.2. Yandex reserves all its rights and ownership over the platform contents. Physical access to the platform does not imply provision of any permission and/or right to use those contents and/or a part thereof.

11.3. Any reference to a name, trademark, product and/or service of any third party in various catalogs is made exclusively as a service for the user and is neither advertisement nor promotion of sales, sponsorship, or any recommendation in respect of them. It is hereby explained, if any supplier infringes the third-party intellectual property rights, the supplier in question will be solely responsible.

11.4. The platform and its contents are intended solely for private and non-commercial use, and their use is solely restricted to the sale and purchase of goods. Do not copy, reproduce, distribute, sell and/or display the materials without prior written permission of Yandex.

12.Indemnification The user undertakes to indemnify Yango for any loss, damage, loss of profit, payment or expenses incurred, including payment of legal fees and legal costs, as a consequence of breaching these terms of use and/or because of any other damage to the platform caused from the user and/or anyone acting on his behalf.

13.Assignment Yango is entitled to assign and delegate its obligations and rights hereunder to any third party without the need to obtain consent from the user.

14.Application of the jurisdiction law

14.1. The agreement between the user and Yango and these terms of use shall be governed exclusively by the laws of Israel.

14.2. Only the competent courts of the Tel Aviv Jaffa Metropolitan Area have exclusive jurisdiction over any matter relating to these terms of use and the use of the platform.
